Quayshaun Hardwell, a 32-year-old from Bad Axe, was arraigned via Zoom from the Huron County Jail in the 73B District Court on Monday, July 22nd.
The charges arose from an incident on Sunday, July 21st, when Hardwell nearly struck a bicyclist with his Cadillac in the parking lot of Ashley's Homestore.
After calling 9-1-1, Huron Central Dispatch issued a BOL (Be On the Lookout), and Hardwell was located shortly afterward by Officer Bischer of the Bad Axe Police Department. Hardwell allegedly failed to comply with the officer's attempt to pull him over, and when he eventually did, he was allegedly intoxicated with his 8-month-old child in the car.
Hardwell now faces three charges: Fleeing and Eluding (Fourth Degree), Operating While Intoxicated (Child Endangerment), and Operating a Vehicle Without a License (Second Offense). The first charge carries a maximum of two years in prison, while the second charge, involving a BAC of 0.17 with a child under 16 in the car, could result in up to one year in jail. The third charge could lead to another year in jail.
Hardwell pleaded not guilty to all charges. He also has 16 pending warrants for arrest or failure to appear in court, including a statewide body bond for a probation violation in Macomb County.
Judge David B. Herrington expressed concerns over Hardwell's driving record and repeated court absences, noting, "Over a dozen situations where he just didn't show up for court. . . I can't imagine that he's going to show up when he's supposed to. If there's a case where flight is concerned, this is it."
Given these factors, Judge Herrington set Hardwell's bond at $20,000 cash or surety.
