Caro man deemed competent to stand trial for allegedly killing son

Legal issues continue against a 27-year-old Caro man who is accused of killing his toddler son earlier this year.
Brian Stewart Elswick is facing five charges. The charges include one count of open murder, one count of first-degree child abuse, and three counts of lying to a police officer. The first two counts are felony charges. If found guilty on those charges, he could be sentenced to life in prison without parole. The charges stem of Elwsik's alleged abuse and death of his one-year-old child.
The case against Elswick started on Feb. 9, when first responders were called for a medical emergency involving a child at a residence at 3086 E. Deckerville Rd., in Caro. A Tuscola County Sheriff's deputy was the first to arrive on scene, and reportedly observed signs of child abuse and/or neglect as he provided first aid to the unresponsive toddler. The child was transported to a hospital and later airlifted to a higher-level trauma center for care, where he died on Feb. 11.
A medical examination determined the child suffered a traumatic brain injury.
Tuscola District Court Judge Jason Bitzer ordered a psychiatric competency evaluation. The examination deemed Elswick to be mentally competent and able to assist in his defense. During the investigation, it was noted Elswick had been involved in alleged injuries of a 10-month-old toddler in 2022 in Oakland County. Tuscola's Circuit Judge Amy Grace Gierhart scheduled a jury trial for Elwsik on August 29.
