Tuscola County, MI.
- A two vehicle crash in August that killed six people including five members of the Amish community is now the subject of a civil lawsuit focused on driver negligence and vehicle ownership liability.
The accident occurred on the afternoon of August 12 at the intersection of Vassar and Fairgrove roads. Authorities say a pickup truck ran a stop sign and collided violently with a van carrying nine Amish residents.
Five passengers in the van died and four others were injured. The pickup truck occupants were also hurt, with one, Robert Ames, dying from his injuries.
"It's amazing anyone lived," said attorney Vic Mastromarco.
The lawsuit was filed by van driver Robert Page against John Stacy, the suspected pickup driver, and Miller Pipeline, the vehicle's last known owner. The suit alleges negligence by the driver, with Mastromarco saying the driver "just blew right through" the intersection.
The Tuscola County Sheriff's Office continues to investigate to determine who was driving the pickup truck. Sheriff Ryan Robinson confirmed there are 22 reports on file related to the crash.
Vehicle ownership is a key point of the lawsuit. The pickup truck had a temporary license plate from Ohio. Mastromarco says the owner is responsible regardless of the driver. A Miller Pipeline official reportedly told the sheriff the truck had been sold before the accident and the new owner may not have transferred the title.
Page is still recovering from significant heart problems caused by the crash. Attempts to reach Stacy and Miller Pipeline for comment were unsuccessful as the lawsuit proceeds.
