A Michigan court recently heard arguments in the case of Jeffrey John Laba, facing allegations he violated the terms of his delayed sentence following a felony assault charge.
The prosecution claims Laba engaged in threatening behavior during a workplace altercation last April, citing his history of aggressive reactions when his wife is involved.
Laba testified he acted with restraint after a coworker verbally abused his wife and then poked him in the chest. Laba stated he told his coworker, "don't touch me again. I just got out of jail for this, and I'm not going back". He reported the incident to his probation officer and filed a police report after being fired the next day.
Conflicting accounts emerged, with his coworker admitting to physical contact in a workplace report but denying it to police, a discrepancy the defense highlighted as undermining his credibility.
The judge expressed frustration over procedural oversights, noting that crucial details of Laba's past violent behavior, including picking someone up by the throat and making death threats, were not available when an earlier decision was made.
Despite these disturbing new revelations, the judge stated he was legally bound by a previous agreement. He formally imposed the negotiated sentence: 45 days in jail for aggravated assault, a misdemeanor, with work release.
Laba is ordered to report to jail Tuesday February 3rd at 6 PM to begin his sentence.
