Michigan AG Criticizes Approval Of DTE Data Center Contract

Michigan Attorney General Dana Nessel expressed strong disappointment following the Michigan Public Service Commission's decision to approve DTE's application to power a 1.4-gigawatt data center in Saline Township.
The approval came despite over 5,500 public comments opposing the plan and bipartisan calls from officials requesting the Commission slow the process. Nessel criticized the fast-tracked, closed-door approval that bypassed a contested case hearing, calling it a failure of transparency.
The AG raised concerns about the contract's redacted details, particularly provisions regarding what happens if the AI companies abandon the project or face bankruptcy. She noted that proposed conditions won't reveal critical information, including exit fees, until December 2027.
Nessel argued the expedited ex parte process prevented proper scrutiny by consumer protection agencies and shielded DTE from accountability.
Her office is reviewing the Commission's order and exploring potential actions to protect Michigan residents.
The Attorney General emphasized that cutting procedural corners leaves ratepayers vulnerable and undermines public trust in regulatory oversight. She pledged to continue advocating for transparency and a process that prioritizes Michigan residents over corporate interests.
