Vassar Township Clerk's Proposed Recall Moves Forward

The proposed recall of one of four Vassar Township officials is moving on to the next step in the process.

"July 8 was the 10-day cutoff for Michael Clinesmith to file an appeal of the election commission's decision approving the recall language presented (for him)," said Tuscola County Clerk Jodi Fetting. "Mr. Clinesmith did not file an appeal so the recall sponsor, Erica Aymer, can now begin collecting signatures."

In order to take the issue to recall Clinesmith, who is the Vassar Township clerk, to the voters to decide if he should be recalled or not a minimum of 377 qualified signatures is needed.

The Tuscola County Election Commission, which consists of Fetting, Treasurer Pat Donovan - Gray, and Probate - Family Court Judge Nancy Thane, each approved the wording on the recall as clear and factual.

Aymer's petition claims Clinesmith should be recalled because he: "refused to follow motion to void and reissue pay checks for three board of trustee members."

The election commission is charged with determining whether the reason stated in the recall petition is based upon conduct occurring during the officials current term of office, and whether each reason given "is factual and of sufficient clarity to enable the officer whose recall is should and the electors to identify in course of contact that is the basis for the recall."

Their determination is not a judgment on the issue.

That is not the only recall petition pending in Vassar Township.

In May, Clinesmith filed recall petitions against Vassar Township Supervisor Bruce Foether, and against Trustees Lynn Gray and Thomas Borcherding.

The reason Clinesmith cited for the recall against three fellow board members is the same on each. He says they should be recalled because they each "voted to approve Resolution 04-2019 restricting the use of the deputy clerk and the deputy treasurer."

On June 17, the election commission approved the wording on the petition against the three officials to be clear and factual.

However those three each chose to exercise their right of appeal the commission's decision in Tuscola County Circuit Court.

"Foether, Borcherding, Gray have filed appeal cases. Those cases are currently with Judge (Amy Grace) Gierhart for review," explained Fetting noting the judge has 40 days to make a determination on the appeal.
